Have you had a road traffic accident in the Czech Republic and are not a Czech citizen? You are entitled to compensation just like anyone else – under Czech law and regardless of your nationality or place of residence.

After an accident in the Czech Republic, compensation is usually governed by Czech law – the law of the country where the accident happened.
There are exceptions – for example, an accident involving a single vehicle with foreign registration plates (typically a passenger’s claim), or an accident in which all the vehicles involved were registered in the same foreign country. In such cases, the claim may be governed by the law of the country of registration. I will determine the applicable law right at the start.
Czech law calculates compensation in its own way. Pain and suffering and permanent consequences are assessed in points according to the Supreme Court Methodology (for non-pecuniary harm to health) (Metodika Nejvyššího soudu), bereaved relatives are entitled to compensation for the mental suffering of bereaved relatives (duševní útrapy), and loss of earnings is calculated according to Czech rules. Procedures, deadlines and insurers’ practices may differ significantly from those in your country – what is usual at home may not apply in the Czech Republic.
The procedure depends mainly on where the vehicle that caused the accident was insured.
I will make the claim directly with the at-fault driver’s Czech insurer under their compulsory motor third-party liability insurance (MTPL) (povinné ručení). If you live in another EU or EEA country or in Switzerland, you can also make the claim with that insurer’s claims representative in your own country – but even there it is assessed under Czech law.
Damage caused in the Czech Republic by a vehicle with foreign registration plates is claimed in the Czech Republic – with the foreign insurer’s representative, or with the Czech Insurers’ Bureau (Česká kancelář pojistitelů, ČKP), which is liable for foreign vehicles under the Green Card system.
You are still entitled to compensation. It is claimed from the Czech Insurers’ Bureau out of its guarantee fund.
If criminal proceedings (trestní řízení) are conducted because of the accident, as an injured party you have the right to take part in them and to claim compensation in them. If you do not speak Czech, you have the right to an interpreter. I will represent you. You will only need to come to the Czech Republic in person if the police or the court summon you – typically to be questioned as the injured party.
Four steps that determine how well your claim can be proven later.
Dial 112 – the operators also speak English and German. An accident involving injury must always be reported to the police. Note the case reference number and the police unit investigating the accident.
When dealing with the police, you have the right to an interpreter. Do not sign a statement in a language you do not understand, or anything that could be taken as an admission of fault.

Ideally before you leave the Czech Republic. A power of attorney can also be signed remotely, and taking over the case quickly is important because of the criminal proceedings.
As a foreign national, you can claim the same compensation as a Czech victim – even if you live or work abroad.
The amount of compensation for pain and suffering, permanent consequences and the claims of bereaved relatives is determined by Czech law and the case law of Czech courts. This is what I work with every day.

Under Czech law, claims generally become time-barred after three years, but calculating the limitation periods is complex. Don’t delay in making your claim.
The insurer usually pays compensation on its own initiative, without asking you. Such a payment does not mean your claim has been exhausted – you can often claim an additional payment.
If you are being treated at home, keep all your reports. I will advise you which ones will need to be translated into Czech.

Yes. If you did not cause the accident, you are entitled to compensation from the at-fault driver’s MTPL insurance regardless of your nationality, place of residence or how long you had been staying in the Czech Republic.

Under Czech law, bereaved relatives are entitled to compensation for mental suffering, reimbursement of funeral costs and, in some cases, maintenance for dependants. You are entitled even if you live abroad.
